This Terms of Service is an agreement between Future Fonts LLC, an Oregon limited liability company (“Future Fonts”, “we”, “us”, or “our”), and you (“you” or “your”). These Terms of Service govern your access to or use of the Future Fonts service, including our various websites, SMS, APIs, email notifications, and software (“Service”), and any information, data, text, graphics, photos, profiles, or other materials uploaded, downloaded, or appearing on the Service (“Content”). By accessing or using the Service, you agree to be bound by the Terms of Service, including our Privacy Policy (“Terms”). These Terms affect your legal rights and obligations. If you do not agree to be bound by all of these Terms, do not access or use the Service.

Please note that these Terms contains an arbitration clause and class action waiver. By agreeing to the Terms, you agree to resolve all disputes through binding individual arbitration, which means that you waive any right to have those disputes decided by a judge or jury, and that you waive your right to participate in class actions, class arbitrations, or representative actions.

We reserve the right to update or modify the Terms at any time, and will notify you of any update or modification. Your use of the Service following any update or modification constitutes your agreement to follow and be bound by the new Terms. The Service

The Service provides an online social marketplace for fonts and typefaces (“Font” or “Fonts”) provided by third party, independent type foundries (“Foundry” or “Foundries”) in which you and other users of the Service can browse and purchase licenses for Fonts and interact with Foundries and other users. Any dealings you have with Foundries while using the Service are between you and the Foundry. You agree that we are not liable for any loss or claim that you may have against any Foundry, and release us from any claims or liability related to any Foundry or Fonts sold through the Service.

Reserved Rights

Third Party Sites

The Service may contain links to other websites that are not owned or operated by Future Fonts. These linked sites are for your convenience and you access them at your own risk. We have no responsibility or liability for these web sites and are not responsible for the content of such websites. Your use of such websites is subject to the terms of use applicable to each website.

Payment

We do not process payments for the licenses you purchase on the Service. Instead, such transactions are between you and the Foundry providing the License, and are processed by the third party service Stripe provided by Stripe, Inc. (“Stripe”). We store a token generated by Stripe in order for Stripe to process your transactions. Stripe’s terms of service, privacy policy, or other terms govern your relationship with them and their use of your personal information. You can find such terms on Stripe’s website: https://stripe.com. You agree that we are not liable for any loss or claim that you may have against Stripe, and release us from any claims or liability related to your agreement with Stripe.

Use of the Service

You may use the Service only if you can form a binding contract with Future Fonts and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. If you are accepting these Terms and using the Service on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so. You may use the Service only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations.

Your Account

You must create an account with us to use the Service. You agree to provide and maintain true, accurate, current, and complete information about yourself. Registration data and certain other information about you are governed by our Privacy Policy. You are responsible for maintaining the confidentiality of your password and account, and are solely responsible for any activities that occur under your password or account. You agree to immediately notify us of any unauthorized use of your password or account or any other breach of security.

User Conduct

You are solely responsible for your use of the Service, including data charges you incur through use of the Service, any Content that you upload, post, publish, display, or otherwise transmit via the Service, and any related consequences. You may not post or upload any Content to the Service that infringes any intellectual property right or other right of any third party. We may investigate and take appropriate legal action against anyone who, in our discretion, violates this provision, including removing the offending Content from the Service, suspending or terminating associated accounts, or reporting such accounts to the law enforcement authorities. You can use the Services to interact with other individuals, either online or in person. You acknowledge that we do not screen users of our Services, and you release us from any claims or liability relating to your interactions with other users.
